Body Corporate On-selling Obligations
TAKE AWAY LEGISLATION OBLIGATIONS

With new legislation coming into effect from 1st of January 2015, a Body corporate that on-sells electricity to lot owners and tenants are exposed to a range of regulatory risks.
A body corporate that on-sells energy through an embedded network is required to obtain a exemption from the Australian Energy Regulator. This is a huge administration burden ensuring all conditions under their exemptions are met.

Holding an exemption does not “exempt” the body corporate from adhering to the obligations and conditions set out under the appropriate exemption. 

In addition, as an energy on-seller, the body corporate is responsible for managing disconnections, disputes, life support registers, hardship assistance, bad debts etc.
